These Terms of Service ("Terms") are a legal agreement between you and BidBuddy AI ("Screenr", "we", "us") governing your use of the Screenr application and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Screenr is an AI-powered call-screening tool. When an unknown number calls you, Screenr can route that call to an automated AI assistant that answers on your behalf, screens the caller, and gives you a live transcript and voicemail. You can watch a screened call, type replies for the assistant to speak, steer the conversation, or connect the call to yourself.

2. Eligibility & account

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for the security of your account and device, and for all activity that occurs under your account.

3. Carrier call-forwarding (important)

Screenr routes unknown calls to the AI by using conditional call-forwarding provided by your mobile carrier. This feature is operated by your carrier, not by Screenr, and its availability, behavior, timing, and reliability depend on your carrier, plan, device, and network.

We do not control and do not guarantee that call-forwarding will work, that every unknown call will be screened, or that forwarding settings will remain active. Carriers may change, delay, or drop forwarding without notice, and some calls may go to your carrier voicemail or to you directly instead of to the assistant. You are responsible for configuring and maintaining forwarding on your device, and for any charges your carrier applies to forwarded calls.

4. Call recording & consent

The Service records screened calls to produce transcripts and voicemails, and the assistant announces that it is an automated assistant at the start of each call. Laws governing call recording and party consent vary by jurisdiction. You are solely responsible for complying with all recording, wiretapping, and consent laws that apply to you and to the people who call you. By using the Service, you represent that your use is lawful in your jurisdiction. We are not responsible for your failure to comply with those laws.

5. AI limitations & emergencies

The assistant is automated and can misunderstand callers, make mistakes, or produce inaccurate summaries. Do not rely on the Service for calls where an error could cause harm. The Service is not an emergency service and must not be used to place or handle emergency (911) calls. Screenr does not screen or route emergency calls, and you should always have an independent means of reaching emergency services.

6. Acceptable use

You agree not to use the Service to:

  • violate any law, or any third party's privacy, publicity, or other rights;
  • record or intercept communications in violation of applicable consent laws;
  • harass, defraud, deceive, or harm any person;
  • send spam, conduct telemarketing, or evade lawful call regulations;
  • reverse-engineer, resell, or overload the Service, or interfere with its operation or security.

7. Subscriptions & billing

Some features require a paid subscription. Subscriptions are billed through the applicable app store (for example, Google Play) or our payment processor, on a recurring basis, and automatically renew until cancelled. You can cancel at any time through your app-store account; cancellation takes effect at the end of the current billing period, and prior charges are non-refundable except where required by law or store policy. We may change pricing or plan features on notice; changes apply to the next billing period. Fair-use or minute limits may apply to protect the Service and are described in the app.

8. Intellectual property

The Service, including its software, design, and branding, is owned by Screenr and its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of your own content (such as your recordings and transcripts); you grant us the limited rights needed to operate the Service for you as described in the Privacy Policy.

9. Third-party services

The Service relies on third parties, including AI providers, a telephony provider, caller-ID and spam data sources, cloud hosting, and app-store/payment processors. Your use of those services through Screenr may also be subject to their terms. We are not responsible for third-party services or their availability.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT IT WILL SCREEN OR CAPTURE EVERY CALL.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCREENR AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR MISSED OR MISHANDLED CALLS, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold Screenr harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including call-recording and consent laws.

13. Termination

You may stop using the Service and delete the app at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

14. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in Los Angeles County, California will have exclusive jurisdiction, unless a binding arbitration or small-claims provision is added here. Nothing in these Terms limits rights you cannot waive under applicable law.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
